Chautauqua Wind Energy to Capture Green Power Upstate

Calling itself in the “small wind” business as opposed to large-scale, utility-grade wind farms, Chautauqua Wind Energy plans to move into the fledgling market for smaller scale, residential wind turbines beginning this fall. Based in Chautauqua County, New York, the green energy company will focus on installing and servicing 5 to 10 kilowatt wind turbines. The company will act as a dealer and carry turbines from different manufacturers, including Bergey, Windterra, and Helix Wind. Chautauqua will also act as a consultant to determine the optimal installation for each of its customers. Chautauqua County is apparently a prime spot for wind energy. Boasting nearly constant Class 3 winds (15 miles per hour), the area is home to some of the windiest areas in New York State, which is actually the 15th windiest state in the union.

Industry Groups Launch Legal Challenge to Albuquerque Green Building Codes

Albuquerque, New Mexico’s Energy Conservation Codes were signed into law back in January, but their implementation was delayed until July 1 after industry groups voiced concerns during the spring that the Codes were, among other things, preempted by federal law. The Codes purported to raise the standards on the installation of HVAC equipment for all new and retrofit commercial and residential projects to a Seasonal Energy Efficiency Ration (”SEER”) of 15 (for air conditioning) and an annual fuel utilization efficiency (”AFUE”) of 90 percent (for heating). The suit was filed in U.S. District Court for the District of New Mexico by, among other plaintiffs, Air Conditioning, Heating and Refrigeration Institute.

Green Realty Trust: Nation’s First Green REIT is on the Horizon

The prospects for the first completely green Real Estate Investment Trust, or REIT, are closer to becoming reality. A well-known pioneer in the commercial real estate industry has registered an offering with the SEC for a REIT called Green Realty Trust, Inc. As reported first by CoStar Group, Rob Hannah, CEO and co-founder of TSG Real Estate, a Chicago firm, has made what appears to be the first foray into an all-green REIT. Green Realty Trust has devised an investment strategy that aims to meet the need of increasing demand by commercial users and tenants for green standards by increasing the supply of green buildings for lease. The REIT has set up a Green Advisory Council made up of industry experts that will provide analysis on possible acquisitions. According to the CoStar article, Hannah plans to focus the REIT’s acquisition efforts on existing buildings rather than new construction to try and narrow the list of direct competitors.

Eco-Patent Commons: Fertile Ground for Future Green Building Technologies?

Open-source collaboration has fueled the explosion of web-based software applications for years, but what about its potential for developing next-generation green building materials? Several global businesses, including IBM, Sony, Pitney Bowes and Nokia, recently announced their efforts to share patented environmental practices with the public by pledging their environmental-friendly patents to Eco-Patent Commons, a new website hosted by the World Business Council for Sustainable Development (”WBCSD”). The patents, which must either directly or indirectly protect the environment, will be searchable and freely available to all members of the public. WBCSD hopes that the effort will lead to collaborative innovations in energy efficiency, pollution prevention, increased recycling capacity, and the creation of more sustainable materials.

San Francisco’s Proposed Green Building Legislation: Progressive or Plain LEED Creep?

At a press conference last week that was held at Tishman Speyer’s LEED Silver hopeful 555 Mission Street, San Francisco Mayor Gavin Newsom proposed municipal LEED legislation that, if enacted, would be among the most rigorous in the country applying to private construction. Mayor Newsom has vowed to fast-track his signature on the legislation should […]

Green Business Law: PNC Registers “Green Branch” with Trademark Office

“Green Branch” is now a registered trademark of PNC Bank. The U.S. Patent and Trademark Office (”USPTO”) recently granted the mark to PNC, which is actively participating in USGBC’s LEED Portfolio Pilot Program. PNC currently manages forty LEED-certified branch banks in six states, with more on the way. Fifteen of these branches have been certified […]

Surety Industry Raises Red Flags Over D.C. Green Building Act

Concerns over LEED creep (the application of LEED mandates to private projects) include the potential for awkwardly- or hastily-drafted legislation to change the risk structure associated with a given green construction project for various project stakeholders. For example, back in early August, the Surety and Fidelity Association of America (“SFAA”) and the National Association of […]

LEED-AP Designation Not Just for A/E/C

It’s no surprise that this week’s edition of Crain’s reports an increasing number of real estate brokers, marketing professionals, and, yes, lawyers, who are sitting for the U.S. Green Building Council’s exam in pursuit of the LEED Accredited Professional (”LEED-AP”) designation. (The article is not yet available online). Depending on the industry, though, professionals […]

Revisions to Wicks Law Stall; Albany Vows to Push Forward

Back in March, gbNYC joined various industry leaders in calling on Albany to repeal the Wicks Law, anachronistic 1920s-era legislation that requires municipal owners in the State of New York, including New York City, to use four separate contractors on any construction project greater than $50,000 for general construction, plumbing and gas fitting, heating and […]

Green Business Law: Need for Green Counsel Becoming Increasingly Salient as Green Claims are Brought Against Design Professionals

I’ve written before about the potential for design professionals to unwittingly expose themselves to unanticipated risks on green construction projects. In a presentation at last month’s 2007 AIA National Convention in San Antonio, Frank Musica, an attorney with a Maryland-based insurance company, provided an overview of twenty-one actual “green claims” brought against engineers and architects. […]
